At the law offices of Posin & Posin, in Las Vegas, we have over 19 years of experience helping individuals recover the benefits due to them under Social Security. We focus our practice on helping people who have been wrongfully denied benefits. Contact our offices to schedule a free initial consultation.
When you have been denied Social Security benefits, the most important thing to do is contact an attorney as soon as possible. You only have 60 days to appeal the decision. Once you have filed your appeal, it can anywhere from 30 days to 10 months before your appeal is resolved.
If you are afraid to contact a lawyer because you don't have the money to pay attorney fees, you need not worry. In Social Security appeals, you don't pay legal fees up front. The fees are a percentage of your recovery and are taken out of the back benefits owed to you.
Once you contact us, we will schedule a meeting to determine the best way for you to proceed, including how you can best document your condition during the course of the appeal. This may include specific recommendations regarding medical documentation.
Your next step will be to request a reconsideration of the initial appeal. We will assist you with this request, making certain that you have filed the appropriate documents and submitting the request for you.
If your request for reconsideration is denied, you can request a hearing with an administrative law judge. We will be your advocate in any Social Security hearing before an administrative law judge. For more information, see our Social Security hearings page.
Once you hire us to handle your appeal, we will start to build evidence to support your claim. We will establish a record of your need for regular medical care, supported by doctor's records. If you are asked to submit to a consultative exam by the Social Security Administration, we will obtain a copy of those findings (which are generally not delivered to you). In these situations, a claim that is denied on reconsideration can often be reversed by the administrative law judge because of the medical evidence accumulated during the process.
It is also important to understand that the appeals process is time consuming. It takes time to get a reconsideration. It also takes time to get an administrative hearing. We will manage your case, making certain that everything stays on track and that all filings are timely completed.
